State and Law are social phenomenons that are very complicated. Our consciousness about state and law plays an important role in our awareness of social, cultural and political issues…This awareness helps us to reach and solve rightly issues of state and law. In the circumstance of Vietnam, which is transforming from a centrally planned economy to a market economy with socialist orientation, the features of state and law shout be consider constituents of the country’s development strategy. In building up the appropriate legal system and the perfect state machinery, besides internal factors, which play a determinative role, the experiences of other countries should be considered. Studying and applying those foreign experiences that are advanced and relevant to the current situation of the other countries will shorten the way to reach the improved legal system and state machinery. The reason that the writer chose China to study and compare with Vietnam because the organization of China’s State machinery had similar features with Vietnam. The development of China about State and law is a precious experience for Vietnam. Furthermore, Vietnam and China are neighbor countries that we have historical relations for a long time.
Firstly, the thesis presented generally about organization of state machinery in Vietnam. In this content, the writer attempts to give a picture of Vietnam’s state including legislative, executive, judicial branches and President as well in that the writer points out advantages and disadvantages of Vietnam’ s State.
Secondly, in this thesis, the writer studies the framework and organization of the People’s Republic of China’s State: Legislative body, President, Executive body, the Central Military Commission and Judicial Body. Based on this content, the writer compares the State’s organization between China and Vietnam to realize what are the similarity and differences as well as good points and drawbacks (if any) of two countries.
Finally, based on the result of the comparison mentioned above, the writer gives proposals for reforming and improving the Vietnam’s State machinery system such as strengthening legislative capacity of National Assembly; changing organizational structures and operational mode of the state administration system; building up judicial independence and rule of laws.
